Appeal Case by Two Former Judicial Officers

Following an appeal by two former judicial officers, the appeal lodged by the Public Prosecutor and the Defendants, Ramzidah binti Pehin Datu Kesuma Diraja Retired Colonel Hj Abdul Rahman and Hj Nabil Daraina bin Pehin Udana Khatib Dato Paduka Seri Setia Ustaz Hj Awg Badaruddin was heard in the Court of Appeal yesterday morning. They appeared before Honourable President of the Court of Appeal, Michael Peter Burrel, Judicial Commissioners Justice Conrad Seagroatt and Michael Victor Lunn.

Simon Farrell QC, who represented both the Defendants, appeared by teleconference from the United Kingdom assisted by Sheikh Noordin bin Sheikh Mohammad. The First Defendant is appealing against her convictions for criminal breach of trust and money laundering offences. Meanwhile, the Second Defendant is also appealing against his convictions for money laundering offences and seeking for his sentence of 5 years imprisonment to be reduced.

Dato Seri Setia Davinder Singh S.C led the Prosecution team and appeared by teleconference from Singapore. Present in the Brunei Darussalam Court were Deputy Public Prosecutors Hjh Suriana Hj Radin, Dk Didi-Nuraza Pg Hj Abdul Latiff and Muhammad Qamarul Affyian bin Abdul Rahman from the Attorney General’s Chambers. Navin Thevar, David Fong, Tan Ruo Yu and Srruthi Ilankathir from Davinder Singh Chambers LLC are also part of the Prosecution team. Simon Farrell QC has completed his submissions for the Defendants’ appeal and the Prosecution has commenced its reply. The appeal will continue again today at 9:30 in the morning, and is scheduled to be heard until the 16th of June 2021.
