Corruption Case

The Bandar Seri Begawan Magistrate's Court has sentenced an ex-prisoner of Sri Lankan nationality, Pathmanathan Jegan @ Muhammad Saifullah bin Abdullah to 12 months imprisonment after he pleaded guilty to giving bribe money amounting B$295.62 to Warder 543 Norizam bin Awang Hidup.

It is an offence under Section 6(a) of Prevention of Corruption Act (Chapter 133) and an offence under Section 109 read with Section 165 of the Penal Code (Chapter 22) for abetting with Norizam to have committed an offence under Section 165 or the Penal Code (Chapter 22).

An investigation conducted by the Anti-Corruption Bureau (ACB) revealed that on or about August 2015, the defendant while serving imprisonment sentence instructed Norizam to corruptly accept the bribe money amounting 200Euros, the equivalent of two hundred ninety five dollars and sixty two cents (B$295.62) sent by the defendant's family through Western Union, Bandar Seri Begawan. It was as a reward for allowing him to use a mobile phone for the defendant to communicate with someone outside the prison without the authorized permission of the Officer-in-Charge. Pathmanathan was sentenced to 12 months in prison for each charge which is to be served concurrently with effect from 1st March 2017.

Meanwhile, when his case was heard at the Magistrate's Court on 29th March 2017, Warder 543 Norizam Awang Hidup pleaded guilty to three (3) charges under Section 59 of Prison Act (Chapter 51) and pleaded not guilty to one charge under Section 6(a) of Prevention of Corruption Act (Chapter 131) and one charge under Section 165 of the Penal Code (Chapter 22). The Magistrate Court fixed the hearing date on 5th to 17th March 2018.
