Touching on the implementation of the Shari'ah Penal Code Order 2013, Yang Berhormat Pehin Udana Khatib Dato Paduka Seri Setia Ustaz Haji Awang Badaruddin said the order is set to its foundation. The implementation, according to Yang Berhormat Pehin, was enforced on the 1st of May 2014, while the subsequent phases will be implemented as scheduled later, at an administratively appropriate time.
Yang Berhormat Pehin said that the implementation in phases of the Shari'ah Penal Code Order, is aimed to enable the strategic and organised planning and early preparation as well as concrete action that can be first taken by all relevant agencies, not just those in the religious or shari'ah judiciary services. This includes agencies from the Ministry of Home Affairs such as the Prisons Department and Royal Brunei Police Force, Ministry of Health, the Attorney General's Chambers and others. It is detailed and complete by allocating all rules and procedures which will be made as clear guidance for every agency as well as relevant parties in carrying out their duties and responsibilities in upholding justice.
In response to a query raised by Yang Berhormat Awang Haji Abd Wahab bin Apong, the Minister of Religious Affairs explained on the importance of understanding the Syariah Court Criminal Procedure Code, CPC. According to Yang Berhormat, the Syariah Court CPC is in the process of gazetting several Standard Operating Procedures or S.O.P. Among the SOP's include SOP for coordinated cooperation among religious enforcement section with the Royal Brunei Police pertaining to investigations and enforcement; SOP related to prosecution and coordinating cooperation between Syarie prosecutors with lawyers. The Minister stated that currently, actions have been taken to disseminate the stated SOP's to all officers and staff of related agencies for their understanding on the Syariah Penal Code Order 2013 as they carry out their duties to uphold justice.
